The implementation of labor activities by foreign citizens in the Republic of Belarus is permitted in accordance with the labor legislation of the Republic of Belarus, considering the specifics established by the Law of the Republic of Belarus of December 30, 2010 “On External Labor Migration”
As a general rule, foreign citizens carry out labor activities in the Republic of Belarus subject to the availability of a special permit for the right to engage in labor activities in the Republic of Belarus (hereinafter referred to as the special permit) and the conclusion of an employment contract.
The Law of the Republic of Belarus of December 30, 2022 “On Amendments to the Law of the Republic of Belarus “On External Labor Migration” defined that a foreign citizen who received an education in the Republic of Belarus does not require a special permit to obtain a job in his specialty, regardless of the date of graduation from the educational establishment.
Graduates who take a job outside their field of study are required to obtain a special permit!
Foreign citizens receiving vocational, secondary specialized and higher education in educational establishments of the Republic of Belarus can find employment while studying in any specialty, but for no more than 20 hours a week on the basis of an employment contract.
Since the Labor Code applies to all employees and employers who have entered into an employment contract on the territory of the Republic of Belarus (Article 3 of the Labor Code), in the case of employment in Belarus, according to Art. 26 of the Labor Code, a foreign citizen must present the following documents to the employer of the Republic of Belarus:
- Identification document;
- A record book or student card (if a foreign citizen is a student);
- Workbook, with the exception of those entering work for the first time and part-time workers;
- A diploma or other document of education and professional training confirming the right to perform this work;
- Insurance certificate, medical report on health status and other documents confirming other circumstances related to work, if their presentation is provided for by legislative acts.
